Ooni Pizza Oven Promotional Terms and Conditions

Your entry into the Lending People Ooni Pizza Oven Promotion (the Competition) is subject to the following terms and conditions (Terms and Conditions). Information on how to enter the Competition and the description of the Prize form part of these Terms and Conditions.

The promoter of the Competition is The Lending People Limited, 48 High Street, Auckland 1010, New Zealand (the Promoter).

Competition Period

The Competition commences at 6 PM, 26th September 2023, and closes at 6 PM Tuesday 10th October 2023 (the Competition Period). Entries must be received within the Competition Period.

Who Can Enter

The Competition is open to residents of New Zealand, aged 18 years and over at the time of entry.

Employees of the Promoter and its related companies (and their immediate family members), and employees of agencies (and their immediate family members) professionally connected to the Competition, are not eligible to enter the Competition.

By entering the Competition, you warrant that you meet the entry requirements and accept all of these Terms and Conditions.

You are not required to purchase any services or products from the Promoter in order to enter the Competition. Purchasing services or products will not increase your chances of winning.

By entering this Competition, you consent to your name being published on the Promoter’s social media and its website (if you are a Winner), and you consent to the Promoter contacting you to market its services and products. You must have a public Instagram or Facebook profile. Please see the Privacy Policy below for information on how the Promoter may collect, use and disclose your personal information.

How to Enter

To receive one entry into the draw, please follow these steps:

2. Leave a comment on the promotional post.

1. Follow the Lending People Instagram account; and

2. Leave a comment on the promotional post.

To receive 5 additional entries into the draw please follow these steps:

Late, incomplete, incorrect, non-compliant, discriminatory or otherwise offensive entries may be disqualified.

Entry is limited to six entries per person. An entry must be made individually.

The Prize

There is one prize being 1 x Ooni Karu 12 Multi-Fuel Pizza Oven with an RRP of $699.00 (the Prize).

Except to the extent noted below, the Prize, or any part of the Prize, is not transferable or exchangeable and cannot be redeemed for cash. No compensation will be offered if the Winner is unable to accept the Prize.

The prize will be couriered to any NZ residential address The Winner nominates at no cost. Additional costs resulting from acceptance of the Prize, including (but not limited to) petrol and additional transport costs, are the responsibility of the Winner.

The Winner is responsible for any tax considerations related to accepting the Prize and should seek professional advice prior to acceptance of the Prize.

The Prize Draw

The Prize draw will take place at the office of the Promoter at 48 High Street, Auckland no later than 6PM Wednesday 10th October 2023 (the Draw Date). The Winner will be chosen at random.

The Winner will be notified via email and/or another method of communication (at the Promoter’s absolute discretion) within ten (10) days of the Draw Date. The communication will contain instructions on how to claim the Prize.

The Promoter may disqualify any individual deemed by the Promoter to be ineligible to enter the Competition.

The Prize may be forfeited by the Promoter:

· If a Winner does not claim their Prize within five (5) days of being notified.

· If a Winner fails to comply with any of the Terms and Conditions at any time (whether or not the non-compliance is continuing).

· If a Winner has engaged in unlawful or improper conduct under or in connection with the Competition (whether or not the conduct is continuing).

If the Prize is forfeited for any reason the Promoter will re-draw the Competition as soon as practicable to determine a new Winner. The Winner of a forfeited Prize is not eligible to be included in any re-draw. The new Winner will be notified within five (5) days of the date of the re-draw.

If an entry is invalidated or a Prize forfeited, the Promoter will not, to the fullest extent permitted by law, have or assume any liability whatsoever, or howsoever arising, to the relevant entrant or Winner.

The Promoter’s decision is final and no correspondence will be entered into.

Exclusions and Liability

The Promoter will not be responsible for any late, lost or misdirected entries, including (but not limited to) entries not received due to technical problems.

The Promoter is not responsible or liable to an entrant or Winner for a failure to complete the Competition, or to otherwise comply with its obligations under or in connection with the Competition, to the extent caused by an event or circumstance outside of the reasonable control of the Promoter (excepting a lack of funds for any reason) including technical failures, malfunctions, problems with or damage to equipment (including but not limited to wireless devices, websites, wireless networks, servers, computer hardware or software).

To the maximum extent permitted by law, neither the Promoter nor the dealer, nor their related companies, employees or agencies, shall be liable or responsible for any loss or damage whatsoever (whether direct, indirect, special or consequential) or for personal injury in any way associated with the Competition or the Prize (including, without limitation, the Winner accepting and/or using the Prize), whether arising under contract, tort (including negligence), statute or otherwise.

The Promoter reserves the right, at its sole discretion and acting reasonably, to cancel, suspend or cut short the Competition should any attempt be made to deliberately undermine, compromise, damage or destroy the Competition.

General Matters

The Promoter may, acting reasonably, supplement or update these Terms & Conditions from time-to-time. Your entry into the Competition confirms that you own all necessary rights to provide the intellectual property constituting your entry. All entries remain the property of the Promoter. The Winner waives any claims to royalty rights, remuneration or compensation in connection with use of their name, image and other personal information in connection with the Competition.

This Competition is promoted by the Promoter and is not sponsored, endorsed or administered by, or associated with Instagram or Facebook. By participating in this Promotion you agree to a complete release of Instagram or Facebook from any claims.

This Competition is in no way sponsored, endorsed or administered by, or associated with 'Ooni Pizza Ovens.

No failure to enforce any provision of these Terms & Conditions by the Promoter at any time in any way limits or waives the right of the Promoter to, at a later time, enforce and compel strict compliance with these Terms and Conditions.

Privacy Policy

This privacy policy explains how the Promoter collects, uses, discloses and protects personal information provided in connection with the Competition. Personal information is information about an identifiable individual (a natural person).

A person is not required to provide the personal information that the Promoter requests but, if they choose not to do so, they may not be able to enter into the Competition or claim the Prize.

The Promoter will collect personal information when a person completes an entry via the internet, including via a Facebook or Instagram app, and directly by email and other communication methods (if you win the Prize). The Promoter may also collect your Internet Protocol (IP) address, location and the web browser details (the Promoter uses some third-party tools to help collect, analyse and store that information, including Google Analytics).

The Promoter collects personal information in connection with entry into the Competition, selecting and assessing the Winner, and providing the Prize to the Winner. The Promoter also uses personal information to:

· promote its services to entrants in the future including through messaging services and email;

· in connection with defending, protecting and/or enforcing its legal rights and interests;

· for any other purpose authorised by an entrant or the Privacy Act.

The Promoter may disclose personal information to:

· businesses that support the provision of the Competition including Meta Platforms Inc (Facebook and Instagram), related companies, information technology service providers, professional advisers);

· lawyers and other professionals in connection with defending, protecting and/or enforcing the Promoter’s legal rights & interests;

· any other person authorised by an entrant, or by the Privacy Act or another law.

A business that supports the provision of the Promoter’s services may be located outside New Zealand. This may mean that personal information is held and processed outside New Zealand.

The Promoter will take steps that are reasonable in the circumstances to keep personal information safe from loss and from unauthorised access, use, modification or disclosure.

Subject to certain grounds for refusal set out in the Privacy Act, entrants have the right to access personal information that the Promoter holds about you and to request a correction to that personal information. If an entrant provides the Promoter with personal information over the internet (directly or indirectly), the provision of that information is, to the maximum extent permitted by law, at the entrant’s own risk. If a link is provided by the Promoter to a website or app (including the websites or apps of Facebook and Instagram), the owner of that site or app will have its own privacy policy relating to personal information. The Promoter recommends that that privacy policy is reviewed before any personal information is provided.
